The 9th sugya of קידושין begins on dof .ו — with ת”ר and concludes on the same page with תיקו. This sugya prioritizes halachic precedents by which it “reviews” the language of the Mishna from unique witness perspectives – comparable to a Sanhedrin court who hears witness testimony on the New Moon. The framers of this sugya employ zero of these hermeneutic rules (middot). Consequently, based upon the T’NaCH precedent: when a specific sugya of NaCH has no שם השם contained within that specific sugya of NaCH prophets, then that sugya exists as a continuation of the privious NaCH sugya middot דאורייתא. The T’NaCH דאורייתא sh’itta of middot precedents the Talmud middot דרבנן likewise follow the דאורייתא middot model. Hence both T’NaCH middot דאורייתא and Talmud middot דרבנן share an אב\תולדות relationship which models the אב טהור חכמה מצוות and קום ועשה ושב ולא תעשה תולדות commandment relationships by which Torah Law qualifies as משנה תורה – common law. The previous sugya stands upon a כלל\פרט inductive logical reasoning.
The classic middot of 7, 10, 13 middot ideally suited to interpret halachic warp vertical threads. Whereas the 32 middot ideally suited to interpret the aggadic horizontal weft threads of the Talmudic text “LOOM”. Just as both T’NaCH and Siddur stand on סמוכים, so too the 9th sugya סמוך to the 8th sugya of our Gemara. A fundamental error made by the much later religious statute law halachic codifications – their arbitrary organization of halachot into religious ritual subjects uproots and destroys Talmudic judicial common law future ideal – when Jews slauhgter the Romans and reconquer Yovel liberty for the 12 Tribes and establish the Torah constitutional mandate of Sanhedrin Capital and Torts common law courtrooms.
The fundamental error made by assimilated g’lut Jewry, their av tuma avoda zara worship of other Gods, treats statute law ritual halacha as binding in and of its own right. G’lut לא לשמה Jews worship halacha as the will of God! תורה לא בשמים היא. G’lut Jews have no power nor liberty. Hence just as when David fled unto g’lut and “worshipped other Gods” so too all g’lut Jews throughout history. The basis of rabbinic סמוכים follows דאורייתא סמוכים; weigh the Ashkenazi against the Sephardi Order of פסוקי דזמרה – where סמוכים elevates a שבח unto a שם מלכות ברוכה. The precise Order of the פסוקי דזמרה not central because whether before or after the שם ומלכות blessing, סמוכים\structural juxtaposition/ transforms this lower order כמו תהלים שבח unto a שם ומלכות שבועה ברכה.
Consequently the g’lut narishkeit of davening the Siddur according to the טיפש פשט simple meaning of words as false as the assumption that a Goy can read his bible translations and understand T’NaCH common law. The latter inductive Oral Torah reason-logic learns through making comparative precedents! צדק צדק תרדוף does not correctly translate into become a Frumm religious fanatic who wears outfits of 3 centuries past! סמוכים defines the purpose of the שחרית blessings around the קריא שמע which affixes תפילה דאורייתא to תפילה דרבנן by means of סמוכים; just as do the latter blessings within the Shemone Esrei stand סמוך to the first opening blessing אלהי אברהם – מלכות. Herein explains the השם אלהינו השם in the קריא שמע. Only the revelation of the 13 tohor דאורייתא middot duplicates the k’vanna of accepting tohor middot לשמה as the ‘yoke of the kingdom of heaven’ דאורייתא תפילה שבלב.
Prof. Menachem Elon (1923-2013) sat as a justice of the Israeli Suprem Court (1977-93) and later as Deputy President (1988-93). He also served as the head of the Jewish Law Institute at Hebrew University in Jerusalem. He contrasted Case Law/Common Law (Torah She’be’al Peh) aganst Statutory Law (post-Talmudic codes like the Mishneh Torah or Shulchan Aruch).
The סמוכים works like this: היה מדבר עם האשה על עסקי גיטה וקידושיה……ת”ר הרי את אשתי… איבעיא. The 8th sugya Rabbi Yose and Rabbi Yehuda מדבר עמה על עסקי גיטה וקידושיה … understands that wisdom Torah commandments require k’vanna, just as the korban of Cain rejected together with the barbeque to heaven made by the two eldest sons of Aaron. Torah wisdom fundamentally separates the holiness of commandments similar to blessing discerned from praises.
The תיקו addresses the limitations of inductive פרט כלל logic. The 8th sugya learned the כלל – עסוקין באותו עניין – if a couple discuss קידושין, like a shidduch date and she accepts from him money without saying a word – מקודשת. The 9th sugya addresses a similar פרט question: What if he does not remain silent, but .., מיוחדת לי, עזרתי, צלעתי, תפושתי … speaks using non-standard, ambiguous expressions?
Human speech introduces potential contradictions; any married couple will attest to this reality. While the language צלעתי, עצורתי etc meets the כלל the unconventional language rather than known standard הרי את מקודשת לי – introduces doubt as to his purpose, which lowers the זמן גרמא מצוה to a קום ועשה מצוה.
In a deductive statutory model, a word either fits a predefined definition or it does not. In the Talmudic common-law model, the court must evaluate how a reasonable listener\witness interprets the interaction. Our current sugya accepts the language of לקוחתי מהו, due to דברים כד:א – כי יקח. But all other cases of doubt raised invalid as sanctifying time-oriented commandments. Toldoth commandments and halachot stand upon hazakah presumptions but wisdom Torah commandments require בית מיחוש.
Sugya is between men whether they are Rabbi’s or peasants makes not difference, and yes a lot of commentary offers wisdom just like CS Lewis books offer NT wisdom but only T’N’KH- B”CH are inspired words of our Lord!

A brief overview interpretive analysis of ancient Jewish history. Based upon the כלל: T’NaCH and Talmudic common law command mussar neither teaches history.
The Talmud describes the P’rushim as the guardians of the Oral Traditions passed down to the Tannaim as a masoret. For example: Rabbi Akiva’s פרדס inductive logic reason called a “kabbalah”. The דאורייתא מידות: אל רחום חנון etc define the weft threads of Aggada in the Talmud – which employ the דרוש פשט, whereas the warp threads of Halacha in the Talmud – which employ the רמז סוד. Rabbinic middot include the 7 middot masoret of Hillel, the 10 middot masoret of Akiva, the 13 middot masoret of Yishmael and the 32 middot masoret of Yose HaGalili.
Masechta Shabbat links lighting the lights of Hanukkah with the shabbat candle lighting. Shabbat absolutely forbids doing acts of מלאכה, because this wisdom – defined through the 39 skills required to build the Mishkan – serves as the צד משוטפ of all time-oriented “wisdom” commandments. This latter type of Av Torah commandment differs from secondary תולדות commandments – the latter types do not require k’vanna whereas the former types do require k’vanna.
The Bavli common law commentary to the common law Mishna clearly a g’lut document – Judea no longer existed any more than post the Jewish victory in 1948 Palestine existed as a League of Nations mandate territory given to the British based upon the Balfour Declaration which the 1939 White Paper negated. Josephus wrote that prior to Hasmonean rule that the P’rushim joined together with the Maccabee revolt against the Syrian Greek empire. The ברכת המזון refers to this kingdom as רשעים because it attempted to cause Israel to forget the Torah. Which Torah does that blessing refer to? The Oral Torah.
The Tzeddukim did not limit their assimilation of Greek culture and customs to wanting to turn Jerusalem into a Greek polis City State. They embraced ancient Greek philosophy as well! The defining quality of Greek logic schools – static deductive syllogism bridge-making reasoning – which define both Plato and Aristotle logic. Therefore when lighting the lights of Hanukkah, Jews dedicate only to interpret the K’vanna of Torah commandments (time-oriented) through Oral Torah פרדס inductive logic – idea; to compare Gemara Case/Din halachic precedent to interpret different facets of the language of a specific Mishna.
The Seleucid Greeks together with their assimilated lap dogs – the Tzeddukim priests – attempted to erase, for example the court witness based New Moon calendar laws. They, like so many other ערב רב declared themselves “real Xtian believers” while all other Xtian damned to Hell to worship Satan! Everybody knows that some 1900 years after the revelation of the Torah that the Jews perverted their Torah and replaced Yitzak for Yishmael! Hence the koran sold this “bridge” to Arab and Muslim believers in the heart of the Arabian desert! The Bavli represents the ultimate triumph of the Perushim—surviving without Shlomo’s or Herod Temple that worships God and ignores the burdens of judicial justice among and between the Jewish people – dependent upon Tribal Yovel and brit melah לשמה which remembers the oath sworn to the Avot! The Word of God vs word of Man psychotic insanity directly compares to the worship of wood and stone massive cathedrals. As if Moshe Rabbeinu took Israel out of Egyptian slavery bondage to build a bankrupt series of Temples as do the Goyim worship there Gods throughout the Ages! צדק צדק תרדוף defines Torah אמונה belief in this or that or some other God(s) defines the Torah curse of assimilated avoda zarah!
The P’rushim passed the Oral Torah masoret over to the rabbis. This Oral Torah chain of masoret goes straight back to Moshe Rabbeinu. Cyrus the Great whom the prophet Isaiah called “Moshiach” – a great disappointment. While he paid for the construction of a Temple in Jerusalem, his “k’vanna” not to restore “liberty in the land to the 12 Tribes of Israel” but rather specifically loyalty of the Jews; based upon the gaping holes which the Assyrian and Babylonian kings made their kingdoms vulnerable to foreign invasions. Cyrus built a Temple and used the Tzeddukim has his lap dogs to maintain the steady transfer of wealth back to his kingdom in Persia. Herein defines the classic banana republic which enriches 2% of the populations and therein plunders that land of its wealth and resources!
Oral Torah guiding interpretation and courts, versus becoming a frozen text interpreted only through external/foreign rationalities. That latter bible and koran thumping believers collapse their Old Testament as either replaced by the ‘new covenant’ or corrupted by Jews. Goyim worship their Gods by building grand Cathedrals and block headed domed Mosques. Goyim pervert ancient Jewish “history” as their chief means to control a different narrative/God; Universal monotheism replaces the tribal god of Sinai. Belief in their Universal God defines faith rather than the pursuit of righteous justice among the 12 tribes of Israel. Goyim forever have attempted to control Torah identity – through their strict definition of messiah or prophet!
The דאורייתא מידות – form the revolving wheels of the chariot vision by the prophets. Prophets command mussar which interprets the k’vanna of these middot. The Aggadic weft threads of the Talmud/Midrashim likewise make a drosh back to NaCH kabbalah prophets! The halachic warp threads of the Talmudic “loom” employs מידות דרבנן – primarily the 7, 10, 13 middot of Hillel Akiva and Yishmael. פרדס inductive logic compares a Case/Din to similar Case/Din rulings based upon their shared similarity of middot – either דאורייתא or דרבנן; its this צד משוטף of middot who share the same – so to speak – common denominator – by which Torah sages compare בניני אבות Case\Din studies.
The צד משוטף of every mitzvah wisdom commandment learns from מעשה בראשית; hence the first blessing of the שחרית ברכות (two before and one after) twice states תמיד מעשה בראשית because the Israel portion, when the Cohonim dedicated the morning קורבן עולה read the Parsha of בראשית to validate that all time-oriented commandments learn from this essential Torah precedent! The Book of בראשית restricts the concept of Torah commandments to time-oriented concepts of faith; starting with the Creation aggadah to fruitful and multiply to brit melah to removal of the gid ha’nasheh. The צד משוטף that permits these “fraction” of Torah commandments to add together — all of them wisdom commandments. Confusing the language of “time” as if it refers to the time of day – a טיפש פשט sophomoric translation error = to those made by the NT and Koran av tuma avoda zarah.
Ezekiel’s four living creatures, Daniel’s vision of the ram and goat, Zechariah’s menorah and olive trees, Isaiah’s chariot-throne the inner machinery of the chariot that no external rationalist or Hellenist could ever analyze. Av tuma avoda zarah by definition prioritizes belief in God(s) in the Heavens above and life after death. Both Mishna and Gemara independently denounce attempts made by fools and utter idiots wherein they presume than the mind of Man can “know” the Gods! Such people the Mishna states: better they were never born and the Gemara clarifies: train your tongue to say: I do not know. Both this and that stands upon דברים – תורה לא בשמים היא. Oral Torah common law, by aligning middot compares to the two opposing sights of a rifle; this permits a “sniper” to kill a target down range. Oral Torah so to speak plants the mussar of T’NaCH prophets into the hearts of all “downstream” generations of the chosen Cohen people. The burden rest upon the Yatzir Ha-Tov heart to grow this prophetic mussar into crops of justice among and between our people.
The stop-gap g’lut codes made after the 1st Crusade(s) abomination(s) and during the ghetto gulag, Inquisition war-crimes, to what do they compare today? נטרי קרתא-LIKE religious party kapo Jews who threaten cut an alliance with Arab political parties in the coming elections in order to achieve an Arab majority in the Knesset! ‘ה , the Messiah had not come yet and as we discussed the Messiah has to be God because if the Messiah is human then that is avodah zerah. God was known as Hashem but the name of Mashiach was not yet known. If if he would save the world then a root in the verb yasha makes sense and the names Yehoshua, Yeshua, Yeishu or even the Syriac Isho are prime candidates for the Greek rendering of Mashiach’s name. Are you going going to say then by that logic that Avrahams El Shaday then negates later Hashem?

Here’s my final draft
Why the Yeshiva education system stinks.
Made aliya back in ’91. Called myself an atheist – praise HaShem, even while living in Oklahoma. My family about 7 generations of lawyers & judges. I personally despise the Yeshiva whose sh’itta of education made famous by Reshonim g’lut Jewry, employed to instruct Jewish children in Israel today. Just as the mitzva of Shabbat requires making הבדלה which differentiates between מלאכה from עבודה so too and how much more so study and teaching of Torah requires making הבדלה which separates Common law from Statute law. Alas, Yeshivah students which have crossed my path never taught that Shabbat means week, not the 7th Day of the week, as 7th day Adventists falsely teach!
The Torah opens with מעשה בראשית – Yeshiva educated Jews never ask WHY? Its simply not an issue of translating words from Hebrew\Aramaic to English. The Rambam, his Yad-code basically translated the complex Hebrew Aramaic Talmud unto Hebrew – based upon the language of the Mishna. The Steinsaltz talmud and Art Scroll translations follow the path set by that Reshon. The impact upon the Torah world of the Rambam “translations” of Halacha into a simplified Hebrew most probably saved the language of Hebrew from going the way of Catholic Latin – a dead language. But his statute law code turned post Bar Kachba Mishnaic courtroom common law ideal for the future time when Jews conquer the Homeland and restore the pursuit of justice as our Sinai faith unto a static set of halachic religious laws – a belief system – in this sense: no different from Xtian and Islamic theologies.
The times for the Reshonim, cursed g’lut Jewry – exceptionally harsh. The Romans scattered Jewry following the Bar Kochba revolt to the 4 winds of the empire. Goyim barbarians in all cursed g’lut lands both Xtiandom and Islamic – like Spain, made forced conversions, forced population transfers akin to the ’48 Jews thrown out of all Arab countries! The Reshonim scholars confronted harsh realities on the ground; Jewish settlements tiny & scattered and people during the period, where the Roman road system had collapsed, the Dark Ages, rarely traveled. Spanish Jews – Rambam and Ibn Ezra, the latter fled for his life – from Spain, his son converted to Islam. While the former too fled from the anarchy and chaos of the collapsing Islamic civilization unto Egypt; his brother drowned at sea!
Why did the Torah open with בראשית? That Sefer has few Torah commandments: fruitful and multiply, brit melah, gid hanasheh, the טיפש פשט big 3! But most commentators fail to grasp, (akin to the apostle Paul) that the Torah instructs prophetic mussar through repeated themes. As most reform or conservative rabbis utterly numb. The Hebrew Siddur – an unrecognized Primary Source for Talmudic and Midrashic scholarship! This sefer builds upon סמוכים, which requires a discerning eye. The Siddur stands upon Sefer בראשית; it opens with תמיד מעשה בראשית – twice repeated in the first blessing for the שחרית קריא שמע. That critical phrase answers the opening question of this paragraph. The creation aggadah introduces the theme of Torah “wisdom” known as זמן גרמא מצוות. Shabbat as week distinguishes between לא תעשה מלאכה from תעשה מלאכה through k’vanna.
The bi-polar Rambam ספר המצוות in its טיפש פשט literalism, divides Torah commandments to positive and negative camps. The B’hag by stark contrast, his introduction discerns between Av from toldot commandments; like both mesechta Shabbat and Baba Kama ask the question התולדות הולכים אחרי אבות? Just as quality scholarship separates between Primary from Secondary sources – a Ph”D from a bachelor degree. The Sages distinguished between Torah from NaCH from Writings … Mishna from Gemara, so too and how much more so down stream generations of Yiddishkeit likewise required to respect this masoret of scholarship. The B’HaG recognized T’NaCH\Talmudic common law. The Rambam’s statute law effectively blew out the lights of Hanukka; wherein the P’rushim defeated the assimilated ערב רב Tzeddukim. Perhaps based upon the בנין אב of blowing the shofar; this mitzva of blowing the Shofar – a חכמה – the Rif made the chiddush that a person could blow the Shofar on shabbat before his Court!
The term מלאכה refers to Av Torah commandments – time-oriented commandments – which require k’vanna. Toldot commandments and halachot learned separately – as does the statute law code of the Rambam and the Shulkan Aruch – do not require k’vanna. For example: What constitutes as תפילה דאורייתא vs. תפילה דרבנן also ודוי דאורייתא vs ודוי דרבנן? The Rambam harshly criticized in his Introduction שרש ראשון the B’HaG who ruled תפילה דאורייתא! Yet in Rambam’s 5th positive commandment, he too ruled tefillah a mitzva from the Torah! B’HaG learned Hanukkah, a mitzva from the Torah which the Rambam likewise considered absurd. How did the last of the Gaonim scholars “confuse” rabbinic commandments? The Talmud refers to Hannuka מחובר and the Baali Tosafot refers to קריאת שמע likewise as מחובר. The Av Torah זמן גרמא מצוות – מחובר.
The Baali Tosafot refers to the mitzva of ק”ש as מחובר; meaning time-oriented commandments. The B’HaG refers to the lighting the lights of Hanukkah as a מצוה דאורייתא; meaning זמן גרמא מצוות. The statute codes by contrast err and interpret through a טיפש פשט “time” understood in the literal sense. חכמה defined as זמן גרמא מצוות – חמובר. Whereas תולדות מצוות לא צריך כוונה… זמן גרמא מצוות מחובר לחכמה מן התורה. Just as Shabbat means “week” and not a day in a week, so too and how much more so בראשית introduces the theme of זמן גרמא מצוות as Av tohor commandments and not the World created in 6 days טיפש פשט.
The זמן גרמא only a משל which requires making the logical דיוק נמשל. Not literally “time as in watch”, but Torah wisdom as the נמשל of the משל of זמן גרמא מצוות. Hence to both the B’HaG and the Baali Tosafot: where the Baali Tosafot refers to the mitzva of ק”ש as מחובר; meaning time-oriented commandments. The B’HaG refers to the lighting the lights of Hanukkah as a מצוה דאורייתא; meaning זמן גרמא מצוות. The statute codes by contrast err and interpret through a טיפש פשט “time”, understood in the sophomoric – literal sense. חכמה defined as זמן גרמא מצוות – חמובר. Whereas תולדות מצוות לא צריך כוונה… זמן גרמא מצוות מחובר לחכמה מן התורה. The Av בנין אב for all זמן גרמא מצוות … תמיד מעשה בראשית. Sefer בראשית opens with the Central Torah theme of Av tohor time-oriented commandments. Whereas the Books of שמות ויקרא ובמדבר instruct בניני אבות תולדות מצוות. As these secondary commandments – when attached by means of inductive פרדס inductive reason logic to other similar Case/Din rulings (both in the literature of the T’NaCH prophetic mussar and Talmud ritual halacha) this חכמה compares to the two sights of a rifle which permits the prophets to “shoot” their mussar to all generations of the Chosen Cohen People. Herein defines the warp/weft halachic-aggadic relationship which permits the generations of Israel to make aliya from g’lut toldot commandments to Av tohor זמן גרמא מצוות בארץ ישראל.
The זמן גרמא only a משל which requires making the logical דיוק נמשל. Not literally “time as in watch”, but Torah wisdom as the נמשל of the משל of all זמן גרמא מצוות. Hence the B’HaG and Baali Tosafot, specifically the Rabbeinu Tam most likely, מחובר…חכמה “joined/attached” to that חכמה מן התורה which requires k’vanna. Translating the term עדיף\מחובר misses the point all together. This term refers to the distinction between Av Torah commandments – which require k’vanna from toldot commandments which do not require k’vanna. Hence תפילה דאורייתא that’s ק”ש. The Siddur through סמוכים affixes ק”ש to Shemone Esrei דרבנן.
Brought this example as a proof that T’NaCH and Talmud BOTH command common law legalism which learn through judicial precedents. Translating simply misses the boat and qualifies as a לא לשמה Torah curse, based upon the בנין אב of the 1st Sinai commandment. G’lut Jews cannot keep the Yovel – impossible; no different from the slaves beaten by order of Par’o vertical courtrooms (Star Courts which justified impressment of American sailors seized by British warships on the High Seas). G’lut Yidden got religion through the statute halachic codifications.
Only in Israel can Jews sanctify צדק צדק תרדוף; prior to the Oct 7th 2023 Abomination War, Israelis confronted a judicial crisis! Can Israel achieve self-determination and affix the 12 Tribes to the re-conquered lands of Canaan and therein re-establish our Constitutional Republic wherein the Torah mandates only Federal Sanhedrin courts which possess the mandate to rules the Tribal “legislatures” and Knesset Central Government statute laws through משנה תורה-Legislative Review?

The Pauline “original sin” of Adam such a bull shit model. Why? Torah spins around the central axis of justice/injustice. The “fruits” of knowlege of Good and Evil, validates that both Adam Cain and the 10 generation thereafter all pursued “evil”. But the term “evil” does not mean “sin” as the NT counterfeit substitutes for evil.
Evil has its consequences. The jealous brothers of Yosef sold their “brother” into slavery! This evil cause the House of Yaacov to go into Egyptian g’lut! The exact same theme as Adam and Noach! The latter cursed the first born son of Ham!
The 6 against 6 blessings vs curses sworn at Sh’Cem by the 12 Tribes of Israel obeys the blessing curse Torah which Moshe commanded Yehoshua to do – upon bringing the chosen Cohen people into the land of Canaan.
JeZeus saves from sin – bull shit, has no portion with the first two Sinai commandments. Evil called sin by the NT fraud – a perversion on par with Brit called covenant by both counterfeit religions! Shalom, based upon the shabbat 3 meals stands upon trust. Peace a noun has no direct connection to trust. Hence peace a fraudulent translation of shalom.
Every generation of Humanity experiences the fundamental הבדלה which separates Good from Evil; where ‘fear of heaven’ serves as the foundation of good and no ‘fear of heaven’ serves as the foundation of evil. Despite the NT fraud, “JeZeus saves from sin”, this foundation of the Torah introduced in the opening פרקים of Sefer בראשית, defines the essence of “acceptance of the yoke of the kingdom of heaven” metaphor. Despite the revisionist avoda zarah theologies and their טיפש פשט who worship the world to come narishkeit.
The Talmud publicly repudiates the puke prayer which prays to a Father in heaven above. The mitzva of tzitzit, (the 3rd פרק of the ק”ש תפילה דאורייתא), the aggada in ברכות commands the mussar that mitzvot sanctify only brit Israel now living בעולם הזה; Jews visiting their buried dead tuck their tzitzit into their pockets.
The foreign paradigm of “Sin” perverts the Torah connection of g’lut to tumah. Both bible and koran ignore injustice as tuma middot. The KJT bible perverts tuma as “unclean”. The koran fails to grasp that camel a tumah animal on par with pigs. The birth of children does not make a woman “unclean”.
The tohor\\\…///tumah prototype mirror of the Tree of Knowledge of Good & Evil; the Torah נמשל for this Torah משל, akin to two branches of one tree. This archetype blue-print the counterfeit religions totally fail to grasp; tuma does not mean “SIN”.
The tohor-tuma vision fits hand-in-glove with the blessing\/curse opening Sinai commandments which all Israel (alone) accepted at Sinai; Moshe Rabbeinu in the closing Parsha of ויקרא and repeated – in further detail – in דברים; the Parsha publicly read prior to ר”ה – these two “Crowns” of oath brit מלכות responsibility. They define prophetic mussar ברית חדש understood by rabbi Yechuda as בכל לבבך\כם in the ק”ש תפילה דאורייתא. Whose 3rd פרק defines this mitzva as a time-oriented commandment sworn oath/brit which most essentially entails מלכות לשמה. A king accepts responsibility for the actions of his nation.
Actions have consequences like ripples after a stone thrown into a pond. Post the Bar Kochba revolt Rome renamed Judea to Palestine-Syria, and cast the Jewish people back unto Egypt – a לאו דוקא metaphor for av tuma g’lut.
Post Shoah church & mosque have destroyed their ‘good name’ reputations. Their bemoaning their own g’lut consequences with true Xtians or Muslims blah bhah noise, screams “we do not accept the consequences of our actions”; we have no God because our Gods proven to be dead.
Both fraud faiths NT or Koran embrace inherited guilt rather than cause and effect consequences of knowledge of Good and Evil; rational consciousness of choice, despite the dogma of ‘Free Will’, shares no part with modern Nazism notions of racial DNA models. “The fathers have eaten sour grapes, and the children’s teeth are set on edge” is explicitly rejected through prophetic mussar, instructs the נמשל that all generations must confront the Havdalah, Good\/Evil consequences of ones’ actions which either sanctifies a good name reputation or destroys and profanes a good name reputation.
A person can become tuma without “sin”, ba’al keri or metzora serve as witness. In the Book of מלכים metzora folk informed the king that the Assyrian Army had fled which immediately terminated the famine within the city consequent to the siege. The Pauline Grace/Forgiveness dynamic has no portion in Torah faith just as brit melah and Torah common law has no portion with any church or mosque rule of law or “eirene” – granted by faith in a Hercules (Man\god) savior.
Tzitzit do not learn from any worship of wood and stone grand Temples in Jerusalem! Tzitzit, this wisdom commandment learns from the כלל of Tents established by the Mishkan; if a person dies within a tent – all within the tent become tumah. Covering the head with the tzitzit tallit stands under this Torah mussar, that the wisdom commandment of tzitzit elevates all mitzvot and halachot under this “tent” unto wisdom/time\oriented Torah Av commandments.
The NT “JeZeus” who “saves from sin” but allows ghetto gulags, Inquisition & shoah – simply a logical contradiction on par with the Nakba defeat of Allah whose peoples religiously affirm the Nazi Shoah as their ideal. The Calvinist dotrine of ‘predetermination’ & Lutheran ‘free will’ protestant faiths as corrupt and false as Pope Pius XII watching the Nazi SS herd the Jews of Rome to the death camps … followed up by the post war Rat-lines and pogroms! The NT’s “Original Sin” and “Salvation from Sin” model of faith – a fundamental perversion of the Torah’s “Choice and Consequence” model.

Post Shoah the church proved that its soul has no fear of heaven – the reputation sealed with the slaughter of 75% of western European g’lut Jewry has permanently expose the failure of the Xtian faith to develop the 1st step of faith – fear of heaven.
Just as time-oriented Torah commandments silly reactionary g’lut Judaism failed to grasp that “time” refers to wisdom rather than any version related to a literal “clock” that goes tick-tock so too literalist fools belief that “fear of heaven” refers to God(s) in the Heavens above! Torah לא בשמים היא. Justice within the land of conquered Canaan wherein the Jewish peoples’ common law courts impose fair restitution of damages inflicted by Jews on other Jews defines the meaning of אמונה לשמה.
Avoda zarah לא לשמה worship of other God(s) substitutes. Only Israel accepts the revelation of the Torah לשמה. Hence, when the 12 tribes alone heard the first Sinai commandment followed by its לא לשמה curse 2nd commandment…they feared they would surely die. And that fear came to pass when that generation for the 10th time challenged the 1st and 2nd g’lut curse לא לשמה. Just that simple — no fancy JeZeus or Allah dancing.

Shlosh Esreh Middot HaRachamim revealed at Mount Horev (Sinai) in שמות לד:ו,ז; the kabbalah taught by rabbi Akiva and others stands upon the masoret passed down from the P’rushim. Rabbinic פרדס logic combined with 7 middot of Hillel, 10 middot of Akiva, 13 middot of Yishmael, and 32 middot of HaGalili define the Oral Torah masoret Israel received from our fore-fathers. The status of the revelation of the Torah at Sinai remains unchanged in substance: תבני לי המשכן שאני שוכן בתכם.
Mesechta ר”ה dof 17b emphasizes the function of t’shuva/remembering the oaths sworn by the Avot for the Cohen seed to inherit the lands of Canaan as an eternal inheritance. T’shuva stands in the backdrop of the cursed Wilderness generations who repudiated acceptance of the Torah revelations through 10 tests! Hence post Wilderness generations remember this through the עשרת הדבורות which specifically makes a t’shuva/remembrance of the 10 plagues inflicted upon Egypt and Par’o hardened heart Torah prophetic mussar; a classic Midrashic found in the Sifrei and Talmud which remembers the Yovel from Egyptian slavery.
The later kabbalah taught by Jewish mystics during the Middle Ages, especially following the public burning of all the Talmud manuscripts within the borders of France in 1242, known as the 10 Sefirot expressed in the Zohar continues the mussar of t’shuva. If the physical Talmud burned by church barbarians, the mystical Kabbalah (the Sod level of Pardes), this יסוד, revealed to ensure the Torah’s survival. The פרדס inductive logic highlights the k’vanna of lighting the lights of Hanukkah; which emphatically rejects and abhors the Greek assimilation which defines בית שני avoda zarah.

Why the Yeshiva education system stinks
The times for cursed g’lut Jewry harsh. The Romans scattered Jewry following the Bar Kochba revolt to the 4 winds of the empire. Goyim barbarians in all cursed g’lut lands both Xtiandom and Islamic – like Spain, made forced conversions, forced population transfers akin to the ’48 Jews thrown out of Arab countries!
But most commentators fail to grasp, (akin to the apostle Paul) that the Torah instructs through repeated themes. As most reform or conservative rabbis utterly numb. The Hebrew Siddur – an unrecognized Primary Source for Talmudic and Midrashic scholarship! This sefer builds upon סמוכים, which requires a discerning eye. The Siddur stands upon Sefer בראשית; it opens with תמיד מעשה בראשית – twice
repeated in the first blessing for the שחרית קריא שמע. That critical phrase answers the opening question of this paragraph. The creation aggadah introduces the theme of Torah “wisdom” known as זמן גרמא מצוות. Shabbat as week distinguishes between לא תעשה מלאכה from תעשה מלאכה through k’vanna.
The bi-polar Rambam ספר המצוות in its טיפש פשט literalism divides Torah commandments to positive and negative. The B’hag by stark contrast his introduction discerns between Av from toldot commandments; like both mesechta Shabbat and Baba Kama ask the question התולדות הולכים אחרי אבות? Just as quality scholarship separates between Primary from Secondary sources; the Sages distinguished between Torah from NaCH from Writings … Mishna from Gemara, so too and how much more so down stream generations of Yiddishkeit likewise required to respect this masoret of scholarship. The B’HaG recognized, perhaps based upon the בנין אב of blowing the shofar. Because the mitzva of blowing the Shofar a חכמה, the Rif made the chiddush that a person could blow the Shofar on shabbat before his Court!
The term מלאכה refers to Av Torah commandments – time-oriented commandments which require k’vanna. Toldot commandments and halachot learned separately – as does the statute law code of the Rambam and the Shulkan Aruch – do not require k’vanna. For example: What constitutes as תפילה דאורייתא vs. תפילה דרבנן. The RambaN harshly criticized the 5th positive commandment of the sefer ha mitzvot! The Rambam mocked the B’HaG who ruled that the mitzva of tefillah a mitzva from the Torah! Likewise, B’HaG learned Hanukkah, a mitzva from the Torah. How? The Talmud refers to Hannuka מחובר and the Baali Tosafot refers to קריאת שמע likewise as מחובר.
Translating the term עדיף\מחובר misses the point all together. This term refers to the distinction between Av Torah commandments – which require k’vanna from toldot commandments which do not require k’vanna. Hence תפילה דאורייתא that’s ק”ש. The Siddur through סמוכים affixes ק”ש to Shemone Esrei. The Pauline “original sin” of Adam such a bull shit model. Why? Torah spins around the central axis of justice/injustice. The “fruits” of knowledge of Good and Evil, validates that both Adam Cain and the 10 generation thereafter all pursued “evil”. But the term “evil” does not mean “sin” as the NT counterfeit substitutes for evil. The Pauline model of “Original Sin” and “Salvation”, exposes a fundamental perversion of the Torah’s choice-and-consequence framework, leading to theological and moral failure define av tuma avoda zara expressed by the pervert religions of Xtianity and Islam – both guilty of substituting “Nakba” Gods as the saviors of Israel in Egypt.
Herein defines the k’vanna of the Order of the Rabbeinu Tam tefillen.
JeZeus saves from sin – simply – bull shit. This foreign imported Nicene Creed g’lut caused – av tuma import; simply stated, has no portion with the first two Sinai commandments. Evil called sin by the NT fraud – a perversion on par with Brit called covenant by both counterfeit religions! Shalom, based upon the shabbat 3 meals, stands upon trust. Peace a noun has no direct connection to the trust verb. Hence peace a fraudulent translation of shalom.
Every generation of Humanity experiences the fundamental הבדלה which separates Good from Evil; where ‘fear of heaven’ serves as the foundation of good and no ‘fear of heaven’ serves as the foundation of evil. Despite the NT fraud, “JeZeus saves from sin”, this foundation of the Torah, introduced in the opening פרקים of Sefer בראשית, defines the essence of “acceptance of the yoke of the kingdom of heaven” metaphor. Despite the revisionist av tuma avoda zarah theologies and their טיפש פשט which worships their own ‘world to come’ Pie in the Sky alien narishkeit belief systems. Any judge who hears a case before his court while holding strong beliefs pro or con, as corrupt as if he had accepted a bribe.
The Talmud publicly repudiates the JeZeus prayer which prays to ‘our Father in heaven’. The mitzva of tzitzit, (the 3rd פרק of the ק”ש תפילה דאורייתא), the aggada in ברכות commands the mussar that mitzvot sanctify only brit Israel now living בעולם הזה; Jews visiting their buried dead, halacha commands – tuck your tzitzit into your pockets.
The foreign paradigm of “Sin” perverts the Torah connection of g’lut to tumah. Both bible and koran ignore judicial injustice which fails to make fair restitution of damages as the תקון for hatred without cause, as the av tuma middot consequences of the Torah curse of g’lut. The KJT bible perverts tuma as “unclean”. The koran fails to grasp that camel a tumah animal on par with pigs. The birth of children does not make a woman “unclean”; simply because fruitful and multiply serves as the – so to speak – first born child of all wisdom\time-oriented commandments!
The tohor-tuma vision fits hand-in-glove with the blessing/curse opening Sinai commandments which all Israel (alone) accepted at Sinai; Moshe Rabbeinu in the closing Parsha of ויקרא and repeated – in further detail – in דברים; the Parsha publicly read prior to ר”ה – these two “Crowns” of oath brit לשמה מלכות responsibility. They define prophetic mussar ברית חדש understood by rabbi Yechuda as בכל לבבך\כם in the ק”ש תפילה דאורייתא, the opening paragraph – blessing and the 2nd paragraph – cursing. Whose 3rd פרק defines this mitzva as a time-oriented commandment “sworn oath/brit”. Such a Torah oath brit absolutely & most essentially entails מלכות לשמה.
Post Shoah, both church & mosque – destroyed their ‘good name’ reputations. Their bemoaning their own g’lut consequences with ‘true Xtians or Muslims blah bhah’ excuses, screams “we do not accept the consequences of our actions, made by the generations of our faith”; we have no God because our Gods proven utterly be dead. Where was JeZeus during the Shoah of European Jewry by Xtian monsters? (Europe a self proclaimed Xtian society since Constantine!) Where was Nakba Allah during post WWII repeated attempts to throw the Jews into the Sea – to complete the Nazi Shoah in the Middle East?
Both fraud faiths NT or Koran embrace inherited guilt rather than cause and effect consequences of knowledge of Good and Evil; rational consciousness of choice, despite the dogma of ‘Free Will’, shares no part with modern Nazism notions of racial DNA models. “The fathers have eaten sour grapes, and the children’s teeth are set on edge”, that prophet’s mussar explicitly rejected. Yehezkel instructs the נמשל that all generations must confront the Havdalah, Good/Evil -understanding: the consequences of ones’ actions either sanctifies a good name reputation or destroys and profanes a good name reputation. Declarations of faith in a theologically created abracadabra Tawhid Monotheistic Universal God do not and cannot change the consequences of unjust actions through condemnations of dead generations guilty identical crimes, committed by each and every generation their after!
A person can become tuma without “sin”, ba’al keri or metzora serve as witness. In the Book of מלכים metzora folk informed the king that the Assyrian Army had fled which immediately terminated the famine within the city, consequent to the siege. The Pauline Grace/Forgiveness dynamic has no portion in Torah faith just as brit melah and Torah common law has no portion with any church or mosque rule of law or “eirene” – granted by faith in a Hercules (Man\god) savior or some Muhammad who claim himself a prophet without wisdom how the Torah defines this key term. Prophets not mystics whose visions foresee future events. Prophets not witches whose magic speaks to the dead. The Book of Daniel not included in the NaCH prophets because even tohor mysticism such as expressed through Daniel and Zohar and Ari mysticism does not qualify as נבואה
Tzitzit do not learn from any worship of wood and stone grand Temples in Jerusalem! Tzitzit, this wisdom commandment learns from the כלל of Tents established by the Mishkan “revelation”; כלל: if a person dies under a tent – all within the tent become tumah. Covering the head with the tzitzit tallit “Amidah” interprets the k’vanna of tzitzit as mussar. The wisdom commandment of tzitzit elevates all mitzvot and halachot under this Mishkan like “tent” unto wisdom/time\oriented Torah Av commandments.

“Rabbi Akiva’s פרדס”
I know that story, one was killed, one eat the honey and one chopped down a tree and was made acher forever and only Akiva came and left in peace.
I always though a good reason to not enter paradise without Jesus.

The story a mussar story. the נמשל when a person jumps into פרדס lacking maturity. Hence the Sages recommend that a person wait till 40 married with children to study kabbalah.

Moshiach does not depend upon a building any more than bowing down to a graven image. LOL The mitzva of Moshiach a time-oriented commandment which requires k’vanna.

The Mishnah and Tosefta like the church 10 commandments “never existed”. Torah prophets command mussar not history. For an actual Sanhedrin court to rule משנה תורה – legislative review – fundamentally requires Yovel and brit melah לשמה. That’s not a past tense prophetic mussar that can be or already “fulfilled” but a mussar obligation commandment applicable to the living Israelis today!

Sehr geehrter Autor,

These later works did not simply “destroy” Talmudic legal logic, but instead tried to make the diversity of rabbinic discussions systematically accessible for practical situations in life…for judicially crushed and oppressed and enslaved g’lut Jewry in Europe and Arab lands! Intention (kavannah), refers strictly and only to time oriented wisdom commandments applicable to Jewish liberty in the re-conquered lands of Israel.
