The 3rd sugya starts דף ג: תנן בכסף: מנ”ל and concludes on דף ד. אימא דידה הוו צריכה…. Just as Shabbat requires separating 6 days of מלאכה from 1 day forbidden to do מלאכה, so too קידושין as a מלאכה wisdom commandment. האב זכאי בבתו – בקטנותה ובנערותה but not a בוגרת, a daughter 12.5 years and older. Boris Badenov and Natasha Fatale, their statute halachic יד, וכסף משנה codes fail to learn Gemara halachot as משנה תורה precedents with the purpose to review the language of the “Home Mishna”. They erroneously presume that Gemara halachot stand upon their own two feet; just as Boris’s ספר המצוות limits Torah commandments to two basic categories. Their religious halachic codifications negate Talmudic courtroom common law as THE priority of the Framers of both Mishna and Gemara. Both “perverts” fail to grasp the k’vanna of האשה נקנית excludes not only תינוקות בנות but בוגרת as well.

This 3rd sugya learned through the middot of rabbi Yossi HaGallili; learned as an Av Agaddic and Tolda Halacha sugya. Therefore the middot of Hillel, Akiva, and Yishmael while present, my sh’itta focuses only upon rabbi Yossi’s Agaddic middot. My chief criticism made against the Gaonim and Reshonim scholarship upon the sealed masoret Shas Bavli, their failure to prioritize the fundamental basics of Torah common law – interpretation of middot sequence as the foundation of making a tiqqun upon the Yatzir Ha-Tov Oral Torah spirits within the oath brit hearts of the Chosen Cohen people through out the generations. Torah observance must not confuse the klippah/forms of faith with the substance of faith; the dedication of tohor middot whereby the Cohen people pursue justice among our people — within the jurisdiction of Sanhedrin common law courtrooms.
During the years of my youth in Texas and Oklahoma often mocked religious folk (both Xtians and Jews), that as an atheist praise God – despised their religious conservatism. Where was God during the Shoah, this question plagued me as a student at Texas A&M. When evangelicals knocked upon my door would push them off with where was your God Jesus; how long will you harp about your belief in his 2nd coming? Put up or shut up. Religion of all stripes – conservative maintenance of the status quo – Bunk.
בטל to me means reducing my masturbation Ego I. Religion begins and ends with “I believe etc etc etc”. Its false to argue or contemplate upon matters which my mind cannot grasp – like Gods. As a student of Bolshevik foreign policy between the two World Wars\European Civil Wars/, the “Jewish Problem” issue became affixed to “NEVER AGAIN”. Hence the Quartet attempts to resolve their latest “version” of their Jewish Problem and impose their “Final Solution” – divide the Jewish state into warring Islands of Arab Israeli conflicts “managed” by foreign Great Power Gods, as disgusting to me as breakfast with out spiced pork sausage! Humor to me: burning down mangers and laughing at silly conservative religious folk – of all stripes and colors. The prior to moving to Israel in 1991, first time I asked a Muslim believer where the word ברית in the Koran laughing told them to go eat camel flesh. Only a few laughed together with me, even my wife rarely laughs at my jokes.
The theme that shaped my research at Texas A&M the idea that each nation state – unique. Because each people has their own “ethical containment force”, my idea of God. Only Israel accepts the revelation of the Torah at Sinai. Hence the tits on a boar hog theology of Monotheism directly resembles Lewis Carroll’s Mad Hatter. The “Art of War”, which determined my sh’itta of learning T’NaCH and Talmud today: kill the g’lut Gods of all belief system theologies; shattering the trust in these theological created Gods whose very existence depends upon: words ie gospels, poetry ie koran, and the sword ie great power politics domination of the balance of power — my vision of revolution.
Torah defines the essence of “faith”, not as belief in God(s) [The plural form – nails scratching down a chalk-board – to religious monotheists.], but – the pursuit of judicial common law righteous compensation of damages inflicted by Jews upon other Jews – within the borders of the oath sworn lands. Faith in cursed g’lut – by definition cannot exist. Herein defines the 1st and 2nd Sinai commandments. My response to the Holocaust survivor who introduced me to the question: “I was in Auschwitz, where was God?”
Torah wisdom transforms בניני אבות\precedents: קום ועשה ושב ולא תעשה מצוות – which do not require k’vanna – unto time-oriented commandments – the latter – which by definition require k’vanna. All Torah mitzvot and Talmudic halachot – possible to make an aliya of them unto wisdom time-oriented Av commandments. Av commandments require prophetic mussar which dedicates tohor Oral Torah middot as the מלכות of all Torah blessings לשמה. The term: לשמה stands upon the precedent of ר”ה תשובה – remembering the sin of the Golden Calf wherein HaShem threatened to treat the oaths sworn to the Avot as vows that later can be annulled. Herein defines the theology of both Xtianity and Islam – the continuation of the sin of the Golden Calf throughout the Ages. T’shuva requires that Jews remember the oaths sworn by the Avot by which they cut a brit with HaShem to father the Cohen people. T’shuva requires that Jews remember the oaths נעשה ונשמע to accept the Written and Oral Torah Sinai revelations. The precondition of swearing a blessing לשמה, requires a t’shuva which remembers the required הבדלה which separates t’ruma from chol; air blown from the lungs from tohor spirits dedicated from within the Yatzir Ha-Tov heart Shekinah.
Therefore t’shuva rejects the alien Av tuma spirit that a man must repent for his sins. This Xtian and Muslim Av tuma avoda zara has directly impacted assimilated and intermarried and religious Jews – as expressed through the tedious and repetitious מחזור יום כפור ודוי. The rabbinic ודוי language not included in the עצם language of the Shemone Esrei. Confusing a ודוי דרבנן with a ודוי דאורייתא the same as distracted unfocused immaturity which distorts k’lippa with fruit produced by the same tree; the Pauline doctrine of ‘original sin’ dominates Xtian and Muslim notions of repentance. Oral Torah interprets the expulsion of Adam from the Garden as the introduction of g’lut as the Av Torah curse. Foreign substitute Monotheism religions reject taking responsibility for their repeated War-Crime committed throughout history. Post Shoah Arabs modeled their Wars to throw the Jews into the Sea upon the Nazi Shoah. Only Israel accepts the interpretation of the first two Sinai commandments as: Life vs Death, Blessing vs. Curse. The Book of Job amplifies this fundamental Torah acceptance. True understanding of Monotheism = Av tuma avoda zara; Job by at least one Amora – an imaginary man; Job viewed by all as a non Jew.
Torah faith in ארץ ישראל therefore rejects statute law halachic codes and Greek syllogism deductive logic as being equal to a bloody menstrual rag; no different than going to the mikveh while holding a dead rat. The challenge which addresses all generations of Israelis today: can we restore the Written Torah as the Constitution of the 12 Tribes of our Republic which mandates Sanhedrin common law courts throughout the restored Cities of Refuge whereby this Constitution makes the required הבדלה which separates Capital Crimes Courts from Torts Courts. Torah serves not as Av tuma ‘Divine Law’, but rather as the Constitutional mandate for תורה לא בשמים היא. Acceptance of the oath brit sworn at Sinai means that Jews in ארץ ישראל cling to our responsibility that upon justice hinges upon the Life/Death-Blessing\Curse responsibility for how we socially interact with our family, friends, neighbors, and bnai brit citizens within our civilization. Torah rejects the Av tuma spirit that laws derived from sacred texts. The vision of this Torah faith understands “יראת שמים” interpreted through the lenses of “בעל שם טוב” – understood not as affixed to an individual any more than the mitzva of Moshiach not “nailed” to a single individual. But rather that bnai brit Israel has responsibility to maintain their ‘Good Name Reputations’ among our bnai brit alliance allies; starting with the הבדלה between oaths vs vows.
The location of ארץ ישראל, open to invasion from all sides. Domestic politics shapes strategic Foreign Policy alliances with key non Jewish partner countries. This vision applies the Talmudic idea of gere toshav internal Israeli legal residence unto Goyim allies abroad. The foundation with any alliance – which by strict definition excludes Shoah European States classified under the Esav/Moav curse of “NEVER AGAIN” – that Israel cuts alliances with nation states based upon the יסוד of “pursuit of justice”. The commandment to war against Amalek interpreted as directly applicable to the ערב רב אין להם בושת פנים. Antisemitism the direct result of traitor “kapo” Jews who forsake the Torah/Talmud defined culture and customs observed by the Cohen people in ארץ ישראל, and who intermarry with Goyim – like as occurred in the days of Moshe when Pinchas killed a רשע. Responsibility for the Shoah and Amalek key conditions the Jewish people accept the “Yoke of the Kingdom of Heaven”; based upon the בנין אב of the Wilderness generation’s refusal to conquer the oath sworn brit land inheritance amplified by Weizmann’s 1937 plea: “Jews of the World where are you?”

Shall therefore prioritize the study of T’NACH Primary sources listed within as פרט precedents learned within their כלל sugya, based upon the Siddur which Orders tefillah through organized blessings; with an eye upon how this Shemone Esrei Order learns the Oral Torah middot affixed to this sugya of Gemara.

This complex set of arguments contains its external k’lippa shells and its internal prophetic mussar. G’lut communities lack the ability to learn לשמה (for the sake of common law justice), based upon the 1st Sinai commandment and the בנין אב curse imposed upon the Wilderness generation. Just as the latter cursed to die in g’lut and not conquer the oath brit lands so too the former enfeebled, measure for measure, eye for an eye. G’lut communities have forgotten the Oral Torah based upon the ברכת המזון blessing for Hanukkah. Actions have their consequences.
Previously, in both the first two sugyot, compared halacha with halacha from other sugyot from the Sha’s Bavli. In my own private learning extended the 7, 10, 13 rabbinic middot halachic search unto the Sha’s Yerushalmi. In similar fashion as the Talmud compares precedents from different sugyot, based upon a גזרה שוו צד משותף\common denominator/, in similar manner prophetic mussar learns by comparing similar middot precedents, akin to the front/top\side views of a blue-print … the different witnesses giving testimony based upon their different perspectives. The abomination of statute halachic codes totally ignores nullifies and obliviates this key יסוד of T’NaCH & Talmudic courtroom common law. The most egregious king of the Reshonim, the Rambam. His Order of halacha into neat and trim egg-crate subject matter stands as the essence of Roman statute law legalism.
Where his Guide based upon the exposed “bark” of Greek/Arabic philosophy of Aristotle. The substance of his profane Av tuma avoda zara expressed through his arrogant choice to arrange halacha into Roman code-subject matter. Small wonder that the medieval church codifiers of Papal dogmatism too embraced the re-discovered Greek philosophy as their new lover. ירמיהו ג:ו-י serves as a profound prophetic rebuke to the generations.
Our Gemara opens with שמות כא:יא this Parsha משפטים attached at the hip to the closing sugya of יתרו – כ:יט. The opening פרק משפטים – כא:א – כז. The Siddur prioritizes “Order”. This kabbalah serves as the basis, how to correctly learn Chumash as common law rather than Reshonim טיפש פשט. That Parshat יתרו joined at the hip with Parshat משפטים, this strengthen the sh’itta of יש סמוכים בכל התורה כולה.
The closing sugya of יתרו affixed by my sh’itta of learning to the אות ה’ של שם השם לשמה. The grammar לשמה prioritized over לשמו, to teach the סוד kabbalah of Shekinah. רחום similar to the 7th midda רב חסד based upon its similarity to מאי נפקא מינא. The midda of רחום by the way my sh’itta learns – based upon the precedents to uproot the nations of Canaan from the land; to kill the stubborn and rebellious child; remembering the obligation to make eternal war against Amalek\ערב רב Jews who despise their Jewish cultural inheritance and/or intermarry with Goyim; the two blessing\curse Crowns of the Torah which separate ruling the land with justice and enduring atheism\אפיקורוס. Hedonism defined as which emphasized the idea of pleasure, not just in a contemporary context of physical delights, but as a broader understanding of a good life that includes wisdom, friendship, and the absence of suffering.
The midda of רחום dedicates this tohor spirit from within the depths of the Yatzir Ha’Tov as expressed through the Shemone Esrei blessing: ראה בענינו, וריבה ריבנו, וגאלנו מהרה למען שמך, כי גואל חזק אתה: ברוך אתה ה’ גואל ישראל. This blessing stands סמוך to רופא חולי עמו ישראל. This עין טוב midda heals the Jewish people from the tuma Yatzir עיין רע. The midda of רחום dedicates this tohor spirit unto our soul/family and people.
Parshat משפטים – justice most fundamentally depends upon an עיין טוב. An attempt to nail down tohor spirits with words compares to the difficulty to describe shades of different colors with words. Words compare to a person suffering from a disease. Blowing the shofar on ר”ה requires lung power, but the mitzva of blowing the shofar resides in the spirit of the midda אל which remembers the Torah תוכחה where the kapo Jewish ערב רב translated the שם השם לשמה to the word אלהים – אתם ראיתם כי מן השמים דברתי אמכם. Prior to the revelation of the Torah at Sinai אל שדי, אלהים, אל Divine visions in the Heavens, where מלאכים communicated the brit faith within the camps of the Avot. But after Sinai: תורה לא בשמים היא. Hence tefillah a matter of the heart and not the Heavens. רחום pleads that the Jewish people pursue justice among ourselves and therein live in peace within our homeland. The עיין רע – translating the לשמה brit of living middot tohor spirits within the Yatzir Ha-Tov/Shekinah unto the “word of God” אלהים golden calf av tuma avoda zara – match only in its utter profanity by making Roman statute law have dominion over Sanhedrin common law.
This Parsha opens with the central thesis state theme of עבד עברי, which makes a Day vs Night הבדלה similar to shabbat from chol. The disgrace upon a man who prefers slavery over freedom: והגישו אדניו אל האלהים … ורצע אדניו את אזנו במרצע. The mitzva of קידושין does not degrade the dignity of a woman to that of a slave nor a whore – both commonly acquired through money. A man does not “love” that which he does not own. A man acquires the נפש עולם הבא of his wife, based upon the בנין אב of childless Avram who acquired the O’lam Ha’bah souls of his future born Cohen seed – through all generations unto eternity. The mitzva of גט serves as witness; the גט returns the divorced woman’s נפש עולם הבא back to her own “domain”.
Now weigh the implications of: ואם שלש אלה לא יעשה לה ויצאה חנם אין כסף. The window of נערה open for a short period before she matures into a בוגרת. Therefore the interpretation למפריע compels the man to compensate the father despite the נערה now having turned unto a בוגרת? What qualifies as the רוב חסד מאי נפקא מינא? The din of עגונה/chained woman. If למפריע applies to the father, then למפריע equally applies to the power of the courts to annul the קידושין when the רשע refuses to honor the conditions of his sworn oath, made before two kosher witnesses and a minyan of men to sanctify the mitzva of קידושין. A navi בנין אב: ירמיה יא:טו-יז. A כלל\פרט, just as Israel as as a nation can go unto g’lut, so too and how much more so the רשע who refuses to return the נפש עולם הבא back to the domain of his ex-wife. The בנין אב for this: ger tzeddick. Just as a ger tzeddick a new creation; a רשע placed in the ban of נידוי – like the Rambam and Spinoza – a new creation.
Our Mishna האשה נקנית compares to the extremes of a bell graph. It excludes both קטנה ובודרת. Only the middle band, the נערה, fits the halachic/aggadic definition of “אשה” in the sugya. The קטנה our Gemara compares to an immature etrog fruit. The בוגרת to outside the fathers’ domain. However if a man threatens the dignity of his daughter he can demand that the courts respect the Father/daughter family relationship. The halachic category “אשה” not simply biological, but rather bnai brit family. Just as Jews not טיפש פשט “racial” (All can convert and become Jewish.), but bnai brit family. The father’s rights Torah wisdom bound through the mitzva of time-oriented קידושין.

Why Xtian theology sucks
Herman Ridderbos (1909–2007) a prominent Dutch theologian and biblical scholar known for his significant contributions to Reformed theology and New Testament studies. Particularly noted for his works on Pauline theology and eschatology, exploring themes such as the kingdom of God and the role of JeZeus-Christ in salvation. But he hardly qualifies as a philologist. A biased theologian lacking expertise in Hebrew and Aramaic compares to a BS degree vs. a Doctorate degree. He did not specialize in textual criticism, historical war crime guilt of the Xtian church; or even 2nd Temple Jurisprudence.
Specifically, his revisionist theology failed to address the issue that the writings of Paul predate all the Gospel books! Attempts to declare that Mark predates Paul’s letters – a shallow maintain the status quo revisionist history speculation. The book of Mark written in Rome following the destruction of Herod’s Temple. Protestant “Higher Criticism” only applicable to invalidating T’NaCH Primary sources. Small wonder that this “school” collapsed early in the 20th Century, about the time of his birth.
He fails to go beyond the simple shallow literal reactionary reading of Paul’s letters, and address the serious issue that some Jewish scholars argue that Paul served as a spy agent provocateur of Nassi Rabban Gamliel. A don’t confuse me with the facts, I have my religion – nonsense. The “stoning” of both Stephen and Paul violated the pharisee halacha! Paul stoned outside the borders of Judea, the Capital Crimes Sanhedrin courts had no legal jurisdiction outside of Judea!!! The Book of Acts contradicts itself on this very score! It denounces Phariseeic law, yet validates the stoning on the road to Damascus as an event acceptable as ‘formal halachic’ executions. That’s a serious error that he failed to catch.
This disciplinary gap, it skews all theological belief system apologetics from Paul till today. Ridderbos’ canonical-theological –not historical-developmental — contradicts Church requirements whose theological dogmatism promotes the historical existence of JeZeus. The church new religion totally ignores the Torah priority of mussar over history. The possibility that Paul’s stoning – staged!
He infiltrated the budding Xtian movement – traveled to Damascus and alienated Jewish support for this alien false messiah heresy; which completely ignores the mitzva of Moshiach as no different than any other wisdom Torah commandment. Specifically that all Jews in all generations can sanctify this mitzva just as they can the wisdom commandment of Shabbat. Paul’s theology which declared circumcision no longer a Torah mitzva, violates the negative commandment against adding or subtracting Torah commandments. This theology the later Gospel narratives rejected when their fictional Harry Potter messiah declared his purpose – to fulfill Torah commandments; not add or subtract Torah commandments.
He failed to separate and distinguish Torah common law from Roman statute law. A day vs night difference. Courtroom judicial review over Legislative statute law the writings of Paul concealed. This absolute fundamental distinction totally invalidated when he broadly declared to Goyim, “You are not under the Law”. Of course Goyim not under the Law! Goyim to this day never accepted the Torah revelation at Sinai. Torah common law stands upon the authority of the Oral Torah logic system – the פרדס kabbalah which shapes the entire Shas Talmud, to interpret the k’vanna of mitzvot/commandments. The post NT church denies interpretation of k’vanna as the definition of Torah wisdom commandments which require k’vanna.
Proof that Paul acted as a spy “wolf dressed in sheep clothing” Romans 6:14 where he introduces his “theology” substitutionism, and obliviates Torah common law. Substitute theology defines the writings of Paul: for example: the notion of Goyim “grafted” likewise obliviates the mitzva of ger tzeddik. Proof that Paul served to create a new av tuma avoda zara religion – the direct definition of the 2nd Sinai commandment Torah curse. Rather than promote the Torah obligation of “pursuit of Judicial justice” as faith, Pauline substitute theology prioritized belief in JeZeus. Regardless that JeZeus no more provable in “the historical-method sense”, than the Hanukkah revolt against the Syrian Greek empire – based upon the Torah curse 2nd Sinai commandment.
Paul as recorded in Acts 27-28, then traveled to Rome and declared “Jesus the king of the Jews; Jesus the Son of God” when Romans believed that Caesar was “the Son of God”!!! This theology-propaganda totally ignored by Ridderbos. Xtians today, similar to their rejection of Oral Torah inductive logic “interpretations” as the purpose of all Law time-oriented commandments; they likewise insist that only “Modern” scholarship compares the Pauline “Jesus son of God” to the “Caesar son of God”. Hanukkah pre-dates the NT by a Century or more. Yehuda Maccabee waged his rebellion against the Greek Syrian king by swearing the loyalty of Judea to the authority of the “real” king of Syria. Paul as a student of Rabban Gamliel would have known this basic post sealing of the T’NaCH mussar. To obliviate this fact, strongly supports the conclusion that Paul sought to inject a Monotheism belief system into the body politic of Polytheistic Roman society – something like a virus invades a healthy cell. Torah warfare actively entails both blessing and curses. Prior to the great Jewish revolt against the Romans, the Jewish spy sent to Rome to curse the Roman civilization based upon the precedent of Yechuda Maccabbee.
Every nation who abandons their belief systems in their Gods – dies. It happened among the Assyrians, the Babylonians the Persians the Roman empire after it converted to Xtian monotheism, etc etc etc. This an irrefutable historical fact; while historians can and do debate the prime causes for the fall of empires, its interesting that both British and Soviet empires collapsed post Shoah. Where was Jesus?
The EU makes no reference to Xtianity, when it attempted to write its own Constitution. The church belief system views Jesus as a physical man. But Ridderbos theology failed to discern that Torah common law stands upon prophetic mussar, rather than relies upon actual history – like as emphatically does the church. Torah stands upon the foundation that each generation has its day under the Sun. Proof: the sages halachicly sealed the T’NaCH, Talmud, and Siddur – giving all generations an identical masoret playing field!
This basis-condition of classic ancient warfare – to destroy and kill the Gods of enemy nations – expressed in the judgement of the Gods of Egypt and the obliteration of Par’o Army drowned in the Sea of Reeds; followed by the judgment of the Gods of Canaan or also the attempt of Bil’aam to curse Israel to intermarry and assimilate – the Torah definition of the 2nd Sinai commandment. Ridderbos failure to critique this most basic fundamental flaw in Acts.
Instead his theology skewed the NT ‘as reliable church history’; not as a tendentious text with huge legal incoherencies. This truth did not concern nor interest him in the least. Any more than did C S Lewis address the Shoah: Xtian guilt of 2000+ years of war crimes which culminated in “by their fruits you shall know them” – Shoah church guilt/rat-lines and post war pogroms. Leo Tolstoy (1828–1910) failed to condemn the Russian pogroms – another bitter fruit of the Xtian dead religion. Where was Jesus during all the Church war crimes against humanity which resulted in the death of 10s of millions? Ridderbos treats “Son of God” almost entirely as a dogmatic category, not as a subversive imperial counter-claim.
E.P. Sanders (in Jesus and Judaism and The Historical Figure of Jesus) fails to discern the fundamental difference of how Torah defines the key term “prophet” from how the NT re-interprets it as no different than witchcraft. Witches predict the future which the Gospels describe as “fulfill the words of the prophets”. T’NaCH and Talmudic Aggada and later Midrash interpret “prophet” as a person who commands mussar.
The agnostic American historian Bart Ehrman confuses Daniel mysticism-apocalyptic interpretations made upon prophetic mussar (akin to how the Gemara interprets the language of the Mishna), but fails to grasp that all Holy Writings of the Hebrew T’NaCH serve primarily as Gemara-like commentaries to Prophet Mishna-like Primary sources.
